Property purchase agreements

The transfer and acquisition of real estate must be notarized in accordance with Section 311b (1) BGB. This is intended to ensure that the parties involved in the contract are fully informed.

In principle, the notary is obliged to remain neutral and must advise and inform both parties equally. However, the certifying notary is ultimately chosen by one side, with the consequence that property purchase agreements are often designed to be buyer or seller friendly - depending on who has appointed the certifying notary.
