Residential tenancy law

Commercial tenancy law

Unlike residential leases, commercial leases are subject to little regulation. There is no statutory minimum protection for tenants.

The drafting of contracts for commercial leases differs considerably from that for residential leases, as there is much more room for maneuver here. For example, a fixed - albeit long - contract term is almost always agreed for commercial leases. However, such fixed-term tenancy agreements are not desired in residential tenancy law and are only possible in exceptional cases. In the case of a fixed contract term, the tenancy ends without the need for termination. Ordinary termination is generally excluded. The tenant is typically granted a so-called option to extend the lease.

Even if there is a great deal of leeway when drafting contracts, not everything can be agreed indiscriminately in commercial tenancy law. There are numerous pitfalls that can easily trip up an uninformed layperson. Particularly if a tenant is making considerable investments against the background of an agreed long lease commitment, he is well advised not to shy away from the costs of legal advice in order to avoid "nasty" surprises later on.
